Price Chopper and Market 32 Sued by Co-Managers for Failing to Pay Overtime
Together with co-counsel, Conway Legal today filed suit in federal district court in New York on behalf of a former “Co-Manager” who was not paid overtime compensation for working more than 40 hours in a workweek. The lawsuit alleges that hundreds of Co-Managers in over 100 “Price Chopper” and “Market 32” stores in at least 6 states routinely work more than 40 hours a week in order to complete their job duties, yet are denied overtime compensation despite performing work that is substantially similar to those that are entitled to receive overtime. As owner and operator of Price Chopper and Market 32 stores, the lawsuit names The Golub Corporation as the defendant.
The lawsuit alleges that Co-Managers spend the majority of their time performing the same duties as non-exempt employees, including helping customers, working the cash register, moving products, stocking shelves, cleaning the store, and otherwise standing in as a cashier, stocker, or other hourly worker. It alleges that Price Chopper/Market 32 has a policy, pattern, and/or practice of misclassifying Co-Managers as exempt from overtime. It seeks to recover all unpaid overtime owed to Co-Managers who work or have worked for Price Chopper/Market 32 between April 29, 2023 and the present.
