Kroger Sued by E-Commerce Managers for Failing to Pay Overtime
Together with co-counsel, Conway Legal today filed suit in federal district court in Cincinnati, OH, on behalf of a former “E-Commerce Manager” (also known as “E-Commerce Supervisor” or “E-Commerce Leader”) who was not paid overtime compensation for working more than 40 hours in a workweek. The lawsuit alleges that E-Commerce Managers in over 1,200 “Kroger” stores in at least 15 states routinely work more than 40 hours a week in order to complete their job duties, yet are denied overtime compensation despite performing work that is substantially similar to those that are entitled to receive overtime. The lawsuit alleges that E-Commerce Managers spend the majority of their time picking products off the shelf, packing orders, and delivering orders to customers. It alleges that Kroger has a policy, pattern, and/or practice of misclassifying E-Commerce Managers as exempt from overtime. It seeks to recover all unpaid overtime owed to E-Commerce Managers who work or have worked for Kroger between February 27, 2023 and the present.
