AirGas Sued by Branch Managers for Failing to Pay Overtime

Together with co-counsel, Conway Legal today filed suit in federal district court in Philadelphia, Pennsylvania on behalf of two former “Branch Managers” who were not paid overtime compensation for working more than 40 hours in a workweek. The lawsuit alleges that Branch Managers in over 900 “AirGas” stores in at least 15 states routinely work more than 40 hours a week in order to complete their job duties, yet are denied overtime compensation despite performing work that is substantially similar to those that are entitled to receive overtime. The lawsuit asserts collective action claims under federal law. A copy of the legal paperwork that started the lawsuit can be found here.

The lawsuit alleges that Branch Managers spend the majority of their time performing the same duties as non-exempt employees, including loading and unloading delivery vehicles, accepting shipments, sorting cylinders, stocking, using the forklift to move stock, processing deliveries and returned cylinders, time-consuming secretarial work related to gas cylinder deliveries and returns, customer service, cleaning, inventory, and covering shifts for hourly employees. It alleges that AirGas has a policy, pattern, and/or practice of misclassifying Branch Managers as exempt from overtime. It seeks to recover all unpaid overtime owed to Branch Managers who work or have worked for AirGas between April 1, 2024 and the present.
