Giant Eagle Sued for Failing to Pay Overtime to Team Leaders

Together with co-counsel, Conway Legal today filed suit in federal district court in Pittsburgh, PA, on behalf of a former “Team Leader” who was not paid overtime compensation for working more than 40 hours in a workweek. The lawsuit alleges that Team Leaders at Giant Eagle routinely work more than 40 hours a week in order to perform their job duties, yet are denied overtime compensation despite performing work that is substantially similar to those that are entitled to receive overtime.
The lawsuit alleges that Team Leaders spent the majority of their time serving customers, breaking down shipments, preparing food, setting up displays, stocking shelves, physically moving merchandise, counting inventory, and cleaning the store. It also alleges that Giant Eagle has a policy, pattern, and/or practice of misclassifying Team Leaders as exempt from overtime. It seeks to recover all unpaid overtime owed to Team Leaders who worked for Giant Eagle between November 22, 2014 and the present.
On October 28, 2020, the Court recommended granting Plaintiff’s request to send a notice to all other Team Leaders employed by Giant Eagle to make them aware of the lawsuit and to give them an opportunity to join.
